1. Agreement to Terms

By accessing or using Sapien ("the App"), you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you may not access the App.

Sapien is operated by Virtus Opus ("we", "us", or "our").

2. Description of Service

Sapien is an AI-powered application that helps users extract insights from books, understand ideas, and generate shareable content. The service includes:

Quick Insight Mode (~30 seconds)
Understand Mode (~2-3 minutes)
"Share My Take" feature with multiple output formats
Hot Takes Generator
Thinking Profile and identity features

3. Intellectual Property Rights

Original Book Content: Sapien does not reproduce full book content. Generated insights are AI-created summaries and analyses that fall under fair use for educational and commentary purposes.

Your Content:

You retain ownership of your original "takes", edits, and customizations
You grant us a license to store and process your content to provide the service
You may share generated content on any platform

Our Content:

The Sapien app, brand, logos, and UI are owned by Virtus Opus
AI-generated insights are provided for your personal use
You may not resell or redistribute bulk AI outputs commercially

4. No User Accounts Required

Sapien does not require user accounts. The app operates entirely on your device with no registration, login, or personal identification required.

Privacy by Design: All functionality is available immediately without creating an account. Your data is stored locally on your device using UserDefaults.

5. Acceptable Use

You agree not to use Sapien to:

Generate content that infringes on copyrights or trademarks
Create misleading or fraudulent content
Generate harmful, abusive, or illegal content
Attempt to reverse engineer or extract our AI systems
Use automated means to access the service (bots, scrapers)
Circumvent any usage limits or security measures

6. Subscription and Payments

Sapien offers a simple pricing model:

Free Tier: Generate up to 3 insights total (lifetime)
Premium: Unlimited insights and all features after subscription

Important: The free tier provides 3 insights for the lifetime of the app, not per day. After these 3 insights, a subscription is required to continue generating content.

All subscriptions are managed natively through StoreKit 2 (Apple's framework). Refunds are subject to Apple's refund policies. Subscription automatically renews unless canceled at least 24 hours before the end of the current period.

7. Accuracy of AI-Generated Content

Disclaimer: AI-generated insights are summaries and analyses created by artificial intelligence. While we strive for accuracy, they may contain errors or omissions. Always verify important information against original sources.

Sapien is a tool for exploration and learning, not a substitute for reading original works or professional advice.

8. App Usage and Termination

As Sapien does not require accounts, "termination" applies to your license to use the app:

We may revoke app functionality for violations of these Terms
Fraudulent or abusive use may result in subscription cancellation
You may discontinue use at any time by deleting the app

Deleting the app removes all local data from your device. All provisions of the Terms which by their nature should survive termination shall survive.

9. Limitation of Liability

To the maximum extent permitted by law, Virtus Opus shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, goodwill, or other intangible losses
Any inaccuracies in AI-generated content
Any third-party content or services accessed through the App

Our total liability shall not exceed the amount you paid us (if any) in the 12 months prior to the claim.

10. Disclaimer

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, including:

Merchantability, fitness for a particular purpose, or non-infringement
Uninterrupted or error-free service
That AI outputs will always be accurate or appropriate

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Istanbul, Turkey.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.
